Introduction:

Utilities Protection Center, Inc., D/B/A Georgia 811 respects your concerns about privacy. This Privacy Policy explains Georgia 811’s policies and procedures regarding personal and other information about our members as well as excavators who contact us, pursuant to Georgia law, to provide excavation notifications. The policy addresses why Georgia 811 collects the information, what is done with the data, and how it is shared.

This Privacy Policy describes the practices in connection with information that is collected through Georgia 811 websites, software applications, social media pages, e-mail messages, and personal information that is provided to Georgia 811. Providing personal information to Georgia 811 or using Georgia 811 products or services constitute agreement to the terms and conditions of this Privacy Policy.

Definitions

Services: Georgia 811’s Websites, Georgia 811’s Applications, Contact Center or any locate request processing system utilized by Georgia 811.
 
Content: any information or data that is uploaded, submitted, posted, created, transmitted, stored or displayed in a Georgia 811 Service.
 
Excavator: any person or entity engaged in excavation or blasting who contact Georgia 811 to obtain a locate request.
 
Information: all of the different forms of data, content, and information collected by Georgia 811 as described in this Privacy Policy.
 
Member: any person or entity who is a member of Georgia 811.
 
Personal Information: information that identifies or permits the contacting of a specific individual, such as: name, home and business mailing address, email address, user name, payment card or other billing information, social media account information and phone number. Personal Information does not include information that has been anonymized such that it does not allow for the ready identification of specific individuals.
 
Websites: Georgia 811’s websites, including but not limited to Georgia811.com, DiggerDog811.com, My.Georgia811.com, erequest.ga811.com, geocall.ga811.com, and any related websites, sub-domains and pages.

Information That We May Collect

Georgia 811 collects Personal Information from members, excavators and others that can be used to contact or identify individuals and to fulfill Georgia 811’s general and specific operational purposes. Georgia 811 also collects information regarding member facility location(s) and excavator activity. This includes content and information obtained from other sources.

How Georgia 811 May Use Information:

Georgia 811 may use the information for a variety of reasons related to operations, including but not limited to the transmissions of locate requests, conducting data analysis, and providing assistance to members and excavators who need more information regarding their locate requests.

How Georgia 811 May Share Information:

Information collected by Georgia 811 may be disclosed to third parties when it is deemed necessary in order to perform services on behalf of Georgia 811 or on behalf of members and excavators, and when obliged to do so by law. Georgia 811 controls access to information which may include restricting access to personal information to individuals within Georgia 811 who need such information to perform their jobs.

How Georgia 811 May Collect or Share Information That Does Not Personally Identify Individuals/Entities

Georgia 811 may also collect and share information that cannot, on its own, be used to identify individuals/entities. Georgia 811 and its third party service providers may collect such information in a variety of ways. Georgia 811 may use or share non-identifying information for operational or research purposes, industry analysis, improvement of products and services, to better tailor products and services, and where legally required.

Security

Georgia 811 seeks to use reasonable organizational, technical, and administrative measures to protect information within the organization and contained within Georgia 811 websites. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If there is reason to believe that interaction with Georgia 811 is no longer secure (for example, if it is believed that the security of any account with GA811 has been compromised), please immediately notify Georgia 811 of the problem by contacting Georgia 811 in accordance with the “Contact” section below.

Rights and Choices

Subject to applicable law, one may have the right to request access to and receive information about one’s personal information maintained by Georgia 811, update and correct inaccuracies in personal information, and have the information blocked or deleted, as appropriate. Any such rights may be limited in some circumstances. Georgia 811 provides several methods to access, correct, update, or request blocking or deletion of personal information. The right to request deletion of personal information pertains to anyone who submits a request and their respective request.

One may access his/her online ticketing account to update the personal information in that account at any time.

If one would like to review, correct, update, suppress, or delete personal information that has been previously provided, he/she may contact GA811 at the address below.

Please note that Georgia 811 may need to and will retain certain information for recordkeeping or legal compliance purposes and/or to complete any transactions that began prior to requesting such change or deletion (e.g., when there is a purchase or enter a promotion, an individual may not be able to change or delete the personal information provided until after the completion of such purchase or promotion). There also may be residual information that will remain within the Georgia 811 databases and other records, which will not be removed.

California Privacy Rights

Under California’s “Shine the Light” law, California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us, once a calendar year, information which includes a list of all third parties to which Georgia 811 has disclosed personal information, as defined in California Civil Code Section 1798.83 during the preceding year, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year. California residents may request this information in writing by contacting us by email at info@Georgia811.com. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. Please allow up to thirty (30) days for a response.

How We Respond To “Do Not Track” Signals

Some browsers have an optional Do Not Track (“DNT”) feature that allows you to express your preference regarding tracking of your online activity by websites. When you choose to turn on the DNT setting in your browser, your browser sends a signal to websites, ad networks, plug-in providers, and other web services you encounter while browsing to stop tracking your activity via cookies or other tracking technologies. Our Site does not currently respond to DNT browser signals or mechanisms.

Retention Period

We will retain personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

Updates To This Privacy Policy

Georgia 811 may change this Privacy Policy at any time. Please take a look at the “Last Updated” legend at the top of this page to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when the revised Privacy Policy is posted on the Services. By using the Services or otherwise providing personal information to GA811 following these changes, one accepts the revised Privacy Policy.
